BERLIN, Germany, September 2/PRNewswire/ -- As technology leader for personalisation solutions DirectSmile offers
products, which apparently came into the focus of other suppliers. Therefore
DirectSmile is taking legal action against the Saechsische Digitaldruck
Zentrum (SDZ) as well as the parent company, the Saechsische Druck- und
Verlagshaus AG, who have launched a software labelled "DirecType".

DirectSmile based the claim upon the following facts:

Employees of SDZ entered into negotiations about licensing of the
DirectSmile image personalisation software and obtained exclusive information
about the DirectSmile software. Although they signed a
Non-Disclosure-Agreement substantial features of the DirectSmile software
appear in SDZs' product.

Apart from this, the brand "DirectSmile" has been registered in time to
protect it. This did not keep SDZ from labelling their software "DirecType"

From DirectSmiles' judgement the market of the product is limited and
therefore there is a danger of confusion.

Should DirectSmile win the case at the District Court Berlin, SDZ would
have to phase out their software and would have to pay a not insubstantial
compensation.

In the action SDZ argues, that the single components of the DirectSmile
software have been known at all times and that there is no possibility of
confusion regarding the brand. A software whose technology is corresponding
to the DirectSmile software has not been on the market and that in this
respect it is applied for a patent. Under these circumstances everyone has to
form its own opinion about the questionable defence pleadings of the SDZ.

For Christoph Schacht (CEO of DirectSmile) they pushed too hard: "We are
happy about every competitor. But if a competitor gains knowledge about our
product in this way, we have to act. Also in the digital print market the
rules of fair business have to apply without restrictions."

IRVINE, Calif., Sept. 2 /PRNewswire-FirstCall/ -- HiEnergy Technologies, Inc. (BULLETIN BOARD: HIET) (the "Company" or "HiEnergy") announced today that it was notified by the staff of the Securities and Exchange Commission that the formal investigation of HiEnergy has been terminated with no enforcement action. The staff said that it has completed its investigation and no enforcement action has been recommended to the Commission at this time.

As previously disclosed by HiEnergy, the Commission authorized a formal investigation and delivered a Wells Notice to the Company in June 2004, advising it of the staff's intention to recommend enforcement action against the Company. During the course of the investigation, HiEnergy has cooperated with the Commission and its staff.
